Terms and conditions

PREAMBLE

1. These general sales conditions are agreed between TERESA MINEIRO, with office at Rua Barão de Viamonte 59, 2400-137 Leiria, Portugal, tax identification (VAT) number PT231735898 and e-mail address teresaluzmineiro@gmail.com, hereinafter referred to as "COMPANY/BRAND" and the people who wish to make purchases through the website www.teresamineiro.com hereinafter referred to as "User".

2. The parties agree that purchases made through the website www.teresamineiro.com will be governed exclusively by the present contract to the exclusion of any conditions previously available on the website.

 

ARTICLE 1 - OBJECT

1. The purpose of these general sales conditions is to provide and define all the necessary information to the User on the modalities of ordering, sale, payment and delivery of purchases made on the website www.teresamineiro.com.

2. These conditions regulate all the steps necessary to place the order and guarantee the follow-up of this order between the Contracting Parties.

ARTICLE 2 - ORDERS

1. The User places his or her order by completing the purchasing process presented on the website www.teresamineiro.com, adding the product(s) or service(s) he or she wishes to order to the shopping cart.

2. To place an order the User must:

a) Register on the website www.teresamineiro.com, providing for the effect the information requested therein.

b) "login" (providing a combination of e-mail and password chosen by the User at the time of registration).

c) Complete the information and choose the options that are made available to the User throughout the order completion process (delivery and billing address, shipping method, payment method, as well as their VAT and name that, for tax purposes, the User wants to have registered on the invoice).

3. The final confirmation of the order by the User is equivalent to full and complete acceptance of the prices and description of the products available for sale and shipping costs, as well as these General Terms of Sale which will be the only ones applicable to the contract thus concluded.

4. The COMPANY will honor orders received online only up to the limit of available stock. In the absence of product availability, the COMPANY undertakes to inform the User as soon as possible. The COMPANY has the right to cancel any purchase, without justification, returning payment in full to the User.

5. The data on the invoice is the sole responsibility of the User. Once issued, the invoice cannot be reissued with alterations.

 

ARTICLE 3 - PAYMENT

1. On the website www.teresamineiro.com, the COMPANY offers the User the following payment methods:

  • Credit card (Visa, Mastercard, American Express, China UnionPay) - Via Stripe, Inc.

  • Apple Pay- Via Stripe, Inc.

  • Google Pay - Via Stripe, Inc.

  • PayPal

2. In all cases the debit will be made from the User's card immediately after confirmation that the goods have been dispatched. If any ordered products are out of stock, the value of these will be credited to the User's card after the order is closed.

ARTICLE 4 - ORDER CONFIRMATION

1. After receipt of the payment of the order, the User will receive an email with the confirmation of the order. Then, within a maximum of 3 working days (except when there is a temporary warning on the homepage of the website that contradicts this), the User will receive, via e-mail, confirmation of shipment, followed by a tracking number, which will be issued by the courier.

 

ARTICLE 5 - DELIVERY

1. The delivery of orders takes place, at the latest, 15 working days after order processing (in normal situations). Delivery is made by DPD, CTT or other courier listed on the checkout page.

2. Shipping costs are added to the order and can be obtained accurately on the checkout page. These costs depend on the weight of the goods and the location to be delivered, so the exact amount will be calculated on the checkout page after the User fills in their address details in step "2. Shipping".

3. Shipments in mainland Portugal can be delivered between 1 to 3 working days. In other EU countries, the BRAND estimates between 3 and 7 working days days. After the issue of the tracking number, the User may have a more realistic prediction of delivery times. The User recognizes, through this document, that the delivery time may differ from the times estimated above, because the delivery is dependent and under the responsibility of third parties.

4. The BRAND cannot be held responsible for delays caused by customs.

ARTICLE 6 - PRICES

1. Prices are in Euros. Under the current regime of the company, and in accordance with European Union directives, the prices shown include taxes and fees, taking into account the VAT in force in Portugal, on the date of payment of the order.

2. No duties on the products will be charged if the delivery address is outside the European Union. However, these shipments may be subject to additional customs duties, taxes and other fees for which the COMPANY assumes no responsibility. To find out more, please seek clarification from the customs office in your country (where the User will receive the shipment).

3. If there is an increase in the price of any product, the User will be informed immediately, and may choose to receive their order (making the payment of the difference) or may proceed to its cancellation.

ARTICLE 7 - CANCELLATION, EXCHANGES AND RETURNS

1. If you wish to cancel your order, this must be requested via email to teresaluzmineiro@gmail.com as soon as possible, given that the processing of orders is always carried out between the day on which the order was made and the following working day. If the order has already been sent, the user will have 14 days after receiving the order to start the return/exchange process.

2. The return process is handled on a case-by-case basis by the BRAND. The request must be sent in writing to the contact email address teresaluzmineiro@gmail.com, within 14 days after the order is received, and the instructions for cancellation or return of the goods will be answered and defined by the COMPANY, by the same means of communication.

3. The return should be made through the same means of payment and will cover the price paid for the products, not covering shipping costs. The User will be responsible for return shipping costs. Any damage or loss resulting from this process will make the refund impossible. For this reason, it is advisable to use registered mail.

4. Upon receipt of the returned item(s), the COMPANY undertakes to reimburse the User within a maximum period of 15 days.

5. Returned products must be in perfect sale conditions, i.e. in the same state in which they arrived at the hands of the User, without any anomaly or damage. Thus, we suggest appropriate packaging and proper protection of the product(s). Upon receipt of the return/exchange, if the product(s) are damaged or defective, the BRAND will be entitled to refuse the refund of the purchase price or the exchange for other product(s).

6. If the value resulting from the exchange of products in an order is lower or higher than the initial value payed, the conditions for the price adjustment will be indicated by the COMPANY.
